By using and navigating the website, The Puppy Paw Post, hereinafter the Website, and by contacting breeders through the Website, User agrees to the following Terms and Conditions:
Website Operation; Third Party Breeders. User understands and acknowledges Mt. Hope Puppies, LLC, an Ohio limited liability company, d/b/a The Puppy Paw Post, hereinafter Operator, owns and operates the Website and Operator’s sole activity is to advertise and list puppies for sale on behalf of third party breeders. User further understand and acknowledges all information about puppies listed on the Website is provided to Operator by said third party breeders. User understands and agrees, if User contacts a third party breeder from information posted on the Website, resulting in the purchase of a puppy from a third party breeder, said purchase constitutes a contract between User and third party breeder and Operator is not a party to said contract. User further understands and agrees Operator is not responsible for the health, genetic condition, breed, color, size, gender or any other characteristic of the puppies listed on the Website. User shall be responsible for User’s own due diligence in determining any puppy listed on the Website conforms to said listing. User shall indemnify and hold Operator harmless for any and all liability, claim, damage, loss, expense or cost (including reasonable attorney fees) arising directly or indirectly, from User’s purchase of a puppy, including without limitation: a health defect, size, color, hair texture, dropping of testicles, DNA testing, issue with delivery or any other claim or circumstance in connection with the purchase of a puppy.
Communication with User. Operator may field complaints about puppies with Users as a courtesy, but is under no obligation to do so. User agrees that all complaints about puppies must be directed to the third party breeder.
Listings. Operator makes efforts to verify the existence, availability and accuracy of its listings, but User acknowledges Operator does not warrant or guarantee the existence, availability and accuracy of its listings or other Website material. Operator makes efforts to work with third party breeders that are in compliance with all laws and regulations, humanely treat puppies and breeding stock and properly care and nurture puppies and breeding stock. Operator further refuses to list puppies for third party breeders that have failed to follow these guidelines on previous listings. User acknowledges Operator does not warrant or guarantee every third party breeder is in compliance with all laws and regulations, humanely treat puppies and breeding stock and properly care and nurture puppies and breeding stock.
Intellectual Property. Operator, its parent companies, successors and assigns, own all intellectual property, including any rights incident thereto, and materials contained on this Website. This provision shall not be construed as a representation that Operator owns any puppies listed on the Website. User is granted access to the Website only for purposes of viewing its contents.
Restrictions. User is specifically prohibited from the following:
publishing any Website material in any other media;
selling, sublicensing and/or otherwise commercializing any Website material;
publicly performing and/or showing any Website material;
using this Website in any way that is or may be damaging to this Website;
using this Website in any way that impacts User access to this Website;
using this Website contrary to applicable laws and regulations, or in any way that may cause harm to the Website, or to any person or business entity;
engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;
using this Website to engage in any advertising or marketing.
Prohibition of Use. Operator, in its sole discretion, may restrict or prohibit any User from accessing the Website at any time. Persons under eighteen (18) years of age are prohibited from using the Website.
User Accounts. Any User identification and password of User will be kept confidential and Operator will not voluntarily provide this information to parties other than User. Users are responsible for safeguarding User identifications, passwords and other account information. Operator will hold User responsible for any account activity or use of the Website by third parties, whether authorized or unauthorized. Operator shall not be responsible to User to any divulsion of account information caused by a breach of security.

Users are prohibited form the assignment, transfer or subcontracting any of the User’s rights or obligations under these Terms and Conditions.
Severability. If any provision of these Terms and Conditions is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Entire Agreement. These Terms and Conditions constituted the entire agreement between User and Operator and supersede any other agreements and/or understandings.
Choice of Law. These Terms and Conditions shall be governed and interpreted in accordance with Ohio law and venue shall lie in the state or federal courts of Ohio.
